1. Parties and Scope:
This Agreement is concluded between the natural or legal person using the technical support platform
(“User”) and the company which is providing the platform Emko Elektronik Sanayi ve Ticaret
Anonim Şirketi (“Provider”), located at Fethiye OSB Mah. Turkuaz Cad. No: 15 Nilüfer/BURSA.
This Agreement covers all AI-powered technical support services provided by the Provider.
2. Nature of the Service:
The technical support provided through the platform is delivered via large language models (including,
but not limited to, ChatGPT and all other artificial intelligence models) and software solutions that
offer automation support based on embedded systems. The Provider may provide automated responses
and guidance without any human intervention.
3. Disclaimer of Liability:
The User hereby acknowledges and declares the following in advance:
a. Any information, guidance, suggestion, drawing, connection, cabling, or hardware installation etc.
provided through the platform does not constitute definitive, binding, advisory, or engineering
consultancy. The services provided by the platform shall in no way be considered as engineering,
project consultancy, or certified technical services. The answers and guidance provided are not to be
considered as recommendations and are not binding.
b. The User declares and undertakes that any and all activities carried out based on the support
provided through this platform are undertaken entirely at their own initiative and responsibility, fully
aware of and accepting all risks in advance. In this context, the User undertakes all risks—including
but not limited to electric shock, short circuit, device malfunction, fire, and damage to property or loss
of life—arising from any actions, installations, assemblies, applications, and other activities performed
based on the information provided on the platform.
c. The Provider shall in no event be liable for any damages, direct, indirect, special, incidental,
punitive, or consequential that may arise or result from the support and information provided.
4. User’s Obligations:
The User accepts that all technical support received and all activities carried out through this support
are their own responsibility and are performed at their own initiative; and acknowledges that, in all
matters for which support and information is received from the platform, it is essential to always
obtain professional technical assistance from competent and authorized persons.
5. Service Warranty and Compatibility:
The Provider does not guarantee the accuracy, up-to-dateness, fail-safe applicability, or compatibility
with the User’s devices of the responses provided. The User acknowledges this in advance. The
Provider may, at any time, change the content of the service provided via the platform, temporarily or
permanently suspend or discontinue all or part of the service.
The technical support platform may always use data and content obtained from third parties. Since
such data is under the control of third parties, the Provider makes no guarantee as to its accuracy, upto-
dateness, or applicability.
6. Data Processing:
Through the technical support platform, the User’s personal data may be collected, stored, and
processed. By using the technical support platform, the User acknowledges and accepts in advance,
within the framework of the Privacy Policy and the Law on the Protection of Personal Data (KVKK),
that their personal data may be collected, stored, and processed.
7. Dispute Resolution:
The Parties agree that Bursa Courts and Enforcement Offices shall have jurisdiction over any disputes
arising from this Agreement.
8. Consent:
The User electronically confirms that they have read, understood, and unconditionally accepted all
provisions of this Agreement prior to using the platform.
